Loan Restructuring, Workout and Foreclosure


Our lending team and our litigation group work hand in hand to tackle restructuring, workout, foreclosure and litigation matters involving distressed or nonperforming loans. We have extensive experience in commercial and real estate financing transactions and work with clients to reach negotiated resolutions of troubled credit situations where possible and in litigation if necessary.


Our team has experience negotiating out-of-court workouts and forbearance agreements, prosecuting judicial mortgage foreclosure actions, handling foreclosure sales under Article 9 of the Uniform Commercial Code (UCC), restructuring loans, negotiating adequate protection for use, or prohibiting use, of a creditor’s collateral by a bankrupt company, recovering possession of a client’s property from borrowers both in and outside of bankruptcy cases, handling assignments for the benefit of creditors, and litigating fraudulent conveyance claims and preference suits.
